The new rule continues the same requirement that no individual worker be on board a crew consist. However, the safe operating speed of a yard train is determined entirely by the railroad certified to maintain the track within Section 213.15. That railroad is responsible for maintaining the track for 25 feet to either side of the rail used for train movement to ensure sufficient resilience to withstand significant deviations from the roadway centerline, as well as to prevent physical damage to machines, wires, buildings and other structures.
The only exception to the 25-foot rule occurs when a yard train is moved through a switch, a turnout or a crossover. In those scenarios, responsible railroads are required to maintain the track for 50 feet on each side of the rail used for movement. This 50-foot rule is a safety factor to prevent derailment.
Although there is currently no statutory or regulatory requirement for the practice of moving locomotives without an attached crew, there is a good safety reason, and consistent industry practice, to move locomotives unattended for routine maintenance and repair. When locomotives are unattended, it is assumed that these locomotives may have one of the many potentially defective conditions requiring repair or maintenance, and consequently one of the many potentially unsafe conditions that have been proven to occur when locomotives are not properly attended.
The new rule allows a train crew member to operate a locomotive unattended by another member of the train crew. However, it is obvious that a person operating a locomotive as an unattended locomotive engineer would not have direct or immediate control over the five other members of the train crew. The locomotive engineer is responsible for the safety of the train movement while in the hands of another part of the crew. In order to keep the locomotive engineer safe, the engineer must understand the other members of the train crew. The engineer must understand that the other members of the crew are accountable to the engineer for the locomotive’s safe operation.
